1. When fixing or approving tariffs or the methodologies to be used by transmission system operators, distribution system operators, LNG facility operators or other regulated entities, including, where applicable, underground gas storage operators, regulatory authorities under Article 57 of Directive (EU) 2019/944 and Chapter X of Directive (EU) 2024/1788 shall take into account the costs incurred and investments made to comply with the obligations under this Regulation, insofar as they correspond to those of an efficient and structurally comparable regulated entity and are transparent. The unit investment costs referred to in paragraph 2 may be used by the regulatory authorities to benchmark the costs incurred by operators. |
Regulation (EU) 2024/1787 of the European Parliament and of the Council of 13 June 2024 on the reduction of methane emissions in the energy sector and amending Regulation (EU) 2019/942 (Text with EEA relevance) article 3 CELEX: 32024R1787 2. Every 3 years, the European Union Agency for the Cooperation of Energy Regulators (ACER) shall establish and make publicly available a set of indicators and corresponding reference values for the comparison of unit investment costs linked to measurement, quantification, monitoring, reporting, verification and reduction of methane emissions, including from leaks, venting or flaring, for comparable projects. The relevant regulatory authorities referred to in paragraph 1 and the relevant regulated entities shall provide ACER with all the data necessary for the comparison referred to in the first subparagraph of this paragraph. |
