A notifying authority shall: (a) be established in such a way as to avoid any conflict of interest with conformity assessment bodies; (b) be organised and operated in such a way as to safeguard the objectivity and impartiality of its activities; (c) be organised in such a way that each decision relating to notification of a conformity assessment body is taken by competent persons different from those who carried out the assessment; (d) not offer or provide any activities that are performed by conformity assessment bodies or consultancy services on a commercial or competitive basis; (e) safeguard the confidentiality of the information it obtains; (f) have at its disposal a sufficient number of competent personnel for the proper performance of its tasks. |
