1. The competent authorities referred to in Article 50(1) shall monitor the use of geographical indications in the market, irrespective of whether the products concerned are in storage or transit, or being distributed or offered for sale at wholesale or retail level, including in electronic commerce. 2. For the purposes referred to in paragraph 1 of this Article, the competent authorities referred to in Article 50(1) shall carry out controls, based on a risk analysis and, if available, on notifications by interested producers of products designated by a geographical indication. Where necessary, those authorities shall take appropriate administrative and judicial steps to prevent or stop the use of names on products or services that are produced, provided or marketed in their territory and that contravene the protection of geographical indications provided for in Articles 40 and 41. |
